1. Acceptance of Terms
Before using Timely-Sentiments.com please take a moment to review the Terms
and Conditions of Use Agreement ("Agreement") that govern your use of
Timely-Sentiments.com ("Website"). By creating an account for use with the
Website, using and viewing the Website (collectively "Use") you are agreeing
to the terms and conditions ("Terms") set forth in this Agreement.
2. Explanation of Service
Timely Sentiments provides individuals with the opportunity to receive email
reminders about upcoming birthdays and to purchase and schedule the delivery
of paper greeting cards, in a convenient and efficient manner, via the
Website (collectively "Services"). Any future changes in features to the
Website or services provided by the Website shall be subject to this
Agreement.
3. Rights and Responsibilities
3.1 Mirroring
You agree to not mirror or use any content (images, logos, text, etc.) or
third-party content, existing now or in the future, without the advanced
written consent of Timely Sentiments LLC.
3.2 Proprietary Rights
This site may contain text, logos, sounds, graphics, photographs, animation,
effects, video recordings and other media elements that are protected by
copyrights, trademarks, and/or other intellectual or proprietary rights
owned by Timely Sentiments LLC or a Third Party. You agree to not copy or
use any of these contents or any other part of the Website without advanced
written consent of Timely Sentiments LLC.
3.3 Conduct
You agree to use the website only for the purpose set forth in this
Agreement. By agreeing to these Terms, you are agreeing to not use the site
for any illegal purpose or to transmit any material that may be considered
offensive, objectionable, illegal, or deemed otherwise objectionable by
Timely Sentiments LLC or any Third Party or to obstruct or violate the legal
rights of any third party. Use of the site must be in concordance with
local, state, federal and International law.
3.4 Use of Content
In agreeing to the terms, as set forth in this Agreement, you agree to not
use any part or portion of the Website (collectively "Content"), whether
protected by legal rights or not, in anyway contrary to the intellectual
and/or proprietary rights maintained by Timely Sentiments LLC, or in anyway
whatsoever, unless otherwise permitted to by written approval from Timely
Sentiments LLC.
3.5 Purchases
You the user are responsible for any financial obligations created by the
purchase of merchandise through the Website. These obligations remain active
until wither the obligation is met or the user is released from the
obligation through written notification by Timely Sentiments LLC. At this
time, all sales are final and returns and/or exchanges will not be allowed,
except when prior permission is obtained, in writing, from the President, or
other delegated employee of Timely Sentiments LLC.
3.6 Scheduled Delivery of Purchased Products
Scheduled delivery of cards is one of the primary services offered by
Timely Sentiments, and it is understood that by assigning dates to purchased
cards, in lieu of using the available "Buy Now" selection, you wish to take
advantage of this scheduled delivery service. By using the scheduling and
recipient list feature of this website the User authorizes Timely Sentiments
to delay shipment of purchased products based on the dates the User
specifies on their recipient list. By using this feature the User
acknowledges that purchased products will not be shipped until those
deferred dates that the User selected.
4. Limited Liability
By agreeing to the terms of this Agreement, you the user agree that you will
not hold Timely Sentiments LLC or any of its associates liable for any
reason that causes compensatory, direct, indirect or consequential damages
to you the user. Unless otherwise restricted by law, Timely Sentiments LLC
or any of its associates cannot and will not be held liable for loss or
profit, loss of data, damage to or loss of property, or any other claims
made by third parties with regard to the Website, Timely Sentiments LLC or
any of its associates. Use of the Website is done at the risk of you the
user and the user assumes all risks and related damages associated with Use
of the Website. Unless restricted by law, liability is limited to greatest
degree as allowed by local, state, federal or international law.
5. Warranties
Timely Sentiments LLC does not provide warranties, implied or expressed,
with regard to the Website or the services provided. Any advice or
assistance provided by employees of Timely Sentiments LLC or any of its
associates does not validate a warranty of any kind. Timely Sentiments does
not assure accuracy or reliability of the information provided on the
Website and cannot be held liable for inaccuracies existing on the Website.
The information, including but not limited to merchandise availability,
prices, and services offered is subject to change without notice to you the
user.
6. Applicable Law
Timely-Sentiments.com operates in accordance with the laws of the
Commonwealth of Virginia and the United States of America due to the
location of Timely Sentiments LLC. By agreeing to this Agreement, you the
user assume the responsibility of compliance to local, state, federal or
International laws governing the use of internet sites, purchasing of goods
and any other law that directly or indirectly relates to the Use of the
Website as defined by this Agreement. Any violation of these laws is the
fault of you the user. Timely Sentiments LLC will not be held at fault for
any or all of the violations of the user.
7. External References
Any reference, including but not limited to links to other websites, to
external content does not validate an endorsement of the content itself or
any of the services provided on the referenced websites. The content and
services provided on such sites is not maintained by Timely Sentiments LLC
and does not fall under the terms of this Agreement. Use of referenced
material is done at the sole risk of the user and discharges Timely
Sentiments LLC from liability for any damages that may result in the use of
referenced material.
8. Customer Information
8.1 Use of Information
All information obtained by Timely Sentiments LLC from the customer,
including email addresses, names, and addresses, will be strictly for the
business directly relating to orders, purchases, account maintenance, and
correspondence to include promotional materials, correspondence and email
reminders. All customer recipient information will not be used for anything
other than actions directly related to orders regarding that recipient and
email reminders about upcoming birthdays.
8.2 Use of Email
Timely Sentiments uses email as the primary means of correspondence with
customers, and for customers to request info from their selected recipients.
As such we respect our customers’ rights to not get spammed with marketing
material and ads, so we use great discretion in the selection of messages to
send. By agreeing to this agreement, you authorize Timely Sentiments to
contact you by email for the purposes of reminders for upcoming birthdays,
account management and maintenance, orders, purchases, promotions, and other
contact directly pertinent to the business relationship between yourself and
Timely Sentiments. By agreeing to this agreement you authorize Timely
Sentiments to send messages you create using our automated message creation
tools to receive updated birthday information from people you wish to
receive reminders about, or for whom you wish to buy cards.
8.3 Release of Information
All information obtained by Timely Sentiments LLC is considered confidential
and will not be sold, given or otherwise released to any third party unless
mandated to by a court of law or otherwise in cooperation with legal
authorities.
9. Changes to Agreement
Timely Sentiments reserves the right to make changes, at anytime, to this
Agreement without prior notification to the user. Under this Agreement, it
is the responsibility of the user to periodically review this Agreement, as
needed, in order to have the most current Agreement.
10. Termination
Termination of this Agreement may be made at anytime for any reason
whatsoever by Timely Sentiments LLC. Termination of this Agreement releases
Timely Sentiments LLC from any obligations to user.
10.1 Inactive Accounts
If no log-in has occurred within a period no less than five years from last
date of log-in to Timely-Sentiments.com, your user account will be
considered inactive and deleted from the Website. Deletion of accounts are
subject to the terms of termination set forth in Section 10 of this
Agreement.
11. Copyright Infringement
If you feel that yours or someone else's work has been improperly used on
the Website, immediately contact Timely Sentiments LLC.
